Residential Street Tree Planting Permit Application

  1. Residential Street Tree Planting Regulations

    The purpose of these planting regulations is to provide an opportunity for homeowners in Fishers to purchase and plant trees at their residence in the public right-of-way along city streets and to do so in a manner consistent with Fishers Approved Street Trees and broader tree care guidelines as outlined in Tree Care Ordinance 012208C.

  2. When do you need a Permit?

    A permit is required when anyone wishes to plant a tree in the area of land between the sidewalk and street. This planting strip is public right-of-way.

  3. 1. Permit Required

    No person shall plant, treat, spray, or prune a street tree or hire someone to care for a street tree unless the Tree Board or its designee first grants a valid permit. Said permit may be issued to property owners or certified arborists. The purpose of this permit is to ensure the planting of desirable trees in the proper location with proper spacing and tree care.

  4. 2. Types of Trees Allowed

    No species other than those identified on the Tree Board's list of approved trees may be planted as street trees without a permit from the Tree Board or its designee.

  5. 3. Property Owner Responsible for Locating Underground Utilities

    The property owner is (by law) responsible for locating underground utilities by calling Call Before You Dig at 811 or 1-800-382-5544. This must be done prior to planting of trees.

  6. 4. Permissions Required

    Property owner is responsible for receiving permission from HOA.

  7. 5. Denying a Permit Request

    The Tree Board or its designee is authorized to deny a permit request when the planting is likely to create a public danger or nuisance, be detrimental to the growth of adjacent trees, or determined to be undesirable based on overall tree characteristics and planting locations.

  8. 6. Tree Dimensions

    Trees must be single stemmed (one central leader) with a minimum size for small trees of 1.5 inches in diameter (measured 6 inches from the ground) and for medium to large trees of 2 inches in diameter (measured 6 inches from the ground).

  9. 7. Planting Strip Width Requirement

    The minimum width for a street tree planting strip is 5 feet. However, 8 feet wide planting strips are preferable.

  10. 8. Tree Planting Location - Planting Strip

    Trees shall be planted in the center of the planting strip.

  11. 9. Tree Planting Location - Prohibitions

    Trees may not be planted under or within 15 horizontal feet of any overhead utility line, or within 5 horizontal feet of any underground utility line. No tree shall be planted within 20 feet from any other tree. No tree shall be planted within 20 feet of the curb of an intersection. No tree shall be planted within 10 feet of a streetlight. No tree shall be planted within 5 feet of a driveway. No tree shall be planted within 3 feet of a hydrant. However, 10 feet is preferred.

  12. 10. Trees Planted in Violation of Regulations may be Removed

    Trees planted in violation of regulations are subject to removal by the City of Fishers. The cost of removal and replacement of the undesirable trees shall be charged to the responsible property owner.

  13. 11. City may Inspect, Plant, Prune, Maintain, and Remove Street Trees within Dedicated Right-of-Ways

    The City of Fishers is authorized to routinely inspect, plant, prune, maintain, and remove street trees within the boundaries of dedicated right-of-way as deemed necessary to ensure public safety or to preserve and enhance the symmetry and/or beauty of such public grounds.

  14. Call Before You Dig

    You are responsible for locating underground utilities prior to planting trees - Contact Call Before You Dig at 811 or 1-800-382-5544.

  15. Agreement *

    As part of my application to plant a tree or trees in the planting strip between the sidewalk and curb abutting the above property I agree to do so in accordance with the city's regulations governing planting of street trees. I also agree that all trees planted in the planting strip will become the property of the city and thus, can only be pruned thereafter by the City of Fishers unless permitted by the Tree Board or its designee.
